Skilled Worker Visa

1. Skilled Worker Initial Application

The Skilled Worker Visa enables individuals to live and work in the UK by securing sponsorship for a skilled job with a UK employer holding a valid Sponsor Licence. This visa has replaced the Tier 2 (General) Worker category.

Applicants can bring their family members, including dependent partners and children, to join them in the UK. The visa duration depends on the length of sponsorship provided by the UK employer, with a maximum validity of five years before requiring renewal. After five continuous years of residence, visa holders may apply for Settlement (Indefinite Leave to Remain) in the UK.

At JNS Solicitors, we provide expert legal support throughout your Skilled Worker Visa journey. From the initial application to extensions and settlement, we ensure your application is well-prepared, compliant, and aligned with the latest immigration rules.

Eligibility Requirements for a Skilled Worker Visa

To apply for a Skilled Worker Visa, applicants must meet the following criteria:

  • Secure an eligible job offer from a UK employer approved by the Home Office with a valid Sponsor Licence.
  • Ensure the job is at the required skill level (equivalent to RFQ Level 3 or above).
  • Meet the new minimum salary threshold:
    • General Salary Threshold: £38,700 per year.
    • Relevant PhD Holders: £34,830 per year if the PhD is relevant to the job.
    • STEM PhD Holders: £30,960 per year for PhD holders in Science, Technology, Engineering, or Mathematics fields.
    • New Entrants or Jobs on the Immigration Salary List: £30,960 per year.
  • Meet the ‘going rate’ for the specific occupation if it is higher than the threshold listed above.
  • Demonstrate English language proficiency at Level B1 of the Common European Framework of Reference for Languages (CEFR), or satisfy the requirement with a GCSE, A-level, or equivalent qualification in English.

Once your UK employer issues a Certificate of Sponsorship (CoS), your visa application must be submitted within three months of the CoS assignment.

2. Skilled Worker Visa – Extension

The Skilled Worker Visa allows individuals to work and live in the UK for a specified period. If your visa is about to expire or your circumstances change, you may be eligible to apply for an extension to continue working under this category. JNS Solicitors is here to guide you through the process, ensuring that your application is accurate and compliant with UK immigration rules.

How Long You Can Stay

A Skilled Worker Visa can last for up to 5 years before requiring renewal. You will need to apply to extend or update your visa before it expires or if you change jobs or employer.

Extensions depend on whether you continue to meet the eligibility criteria, including:

  • Employment in a qualifying role.
  • Earning the required salary.
  • Being sponsored by a licensed employer.

Extensions must be made while you are in the UK; applications cannot be submitted from outside the UK.

Eligibility for Skilled Worker Visa Extension

To qualify for an extension under the same employer:

  • You must currently hold permission to stay in the UK under a Skilled Worker Visa.
  • You must be in the same job role with the same employer who issued your previous Certificate of Sponsorship (CoS).
  • You must continue to meet the salary and skill-level requirements for your role.
  • You must have a new CoS from your employer for the extension application.

Dependents on your current visa, including children who turned 18 during your stay, can also be included in your extension application.

Change of Employment Applications

If you plan to change employers, your new employer must issue a new CoS before you can apply for an extension. Changes in roles within the same employer may also require a change of employment application in certain circumstances, such as:

  • Your core duties change, requiring a different Standard Occupational Classification (SOC) code.
  • Your salary changes below the required rate, except for acceptable reasons such as maternity, paternity, adoption, or long-term sick leave.
  • You move from a role on the shortage occupation list to one not on the list.

Our team at JNS Solicitors provides expert advice to ensure your application meets all eligibility requirements and is submitted correctly.
